We're finalizing these terms with legal counsel. Nothing here limits the statutory consumer rights you have under EU and Polish law.
These Terms govern your use of EzMrch, whether you are a Buyer ordering or reserving merchandise at an event, an Artist (an artist, band, label or promoter — also called a Licensor) whose merchandise EzMrch produces and sells under licence, or an event organizer that sells its own merchandise using EzMrch as software. Some sections apply to everyone; Part A covers Buyers, Part B covers Artists, Licensors and event organizers.
By using EzMrch you agree to these Terms and to our Privacy Policy. Buyers accept when they place an order or reservation (including ticking the consent box at checkout); Artists/Licensors accept when they register and each time an event or product is published for them; event organizers using EzMrch in software mode additionally have a separate Platform Services Agreement with us (Section 10). You must have the legal capacity to enter a contract where you live (generally 18, never under 16). If you act for an organization, you confirm you are authorized to bind it. EzMrch is used at live events in one of two modes — and who your seller is depends on the mode:
You never have to guess which mode applies: every event page, checkout screen and order confirmation shows a Seller & Responsibility Card naming the seller — its full legal name and contact details, who receives your payment, who issues the receipt, and who handles withdrawal, conformity complaints and refunds. The card is preserved with your order.
We provide the Service on a commercially reasonable best-efforts basis. Events, venues and networks are unpredictable, so we can't guarantee the platform is available 100% of the time.
These rules apply at every event, whichever mode it uses. Adding items to your cart places a short hold on the stock (about 15 minutes). If you don't complete checkout in that window, the hold is released and the items return to sale. Provide a valid email address — it's the only channel we use to send your pickup code and order updates.
Orders and reservations are handed out at the event's merch booth against your pickup code or QR pass. Keep the code private — anyone presenting a valid code can collect. Check the Seller & Responsibility Card (Section 2) to see whether Section 5 or Section 6 applies to your purchase.
Don't place holds, orders or reservations you don't intend to complete just to deny stock to others, don't resell or trade pickup codes, don't try to obtain goods you haven't paid for, and don't interfere with the Service.
This Section applies when the Seller & Responsibility Card names EzMrch as the seller. At these events EzMrch designs, produces and sells the merchandise under licence from the Artist and is your only contracting party for the purchase: we set the prices, issue the receipts, and are responsible for the goods — their quality, description, safety, sizing and legality — and for complaints, withdrawals and refunds. Artist names, logos and designs on the merchandise identify the licensed brand, not the seller.
Ordering. Your order is confirmed only when you receive a pickup code (and, for card payments, once payment is confirmed). We may decline or cancel an order for a pricing error, suspected fraud, or stock unavailability — and if you were charged, you're refunded in full.
Prices, tax & payment.
Pickup. Booth times are set by EzMrch together with the event organizer and venue; collect during the event unless told otherwise.
Cancellations & refunds. Refunds are handled by EzMrch directly — we are the seller:
Right of withdrawal. Ordering at these events is a distance contract even though you collect at the event. If you are a consumer, you may withdraw without giving a reason within 14 days of the day you (or a person you named) take physical possession of the goods — and at any time before pickup. To withdraw, email hello@ezmrch.com with your order number (a statutory model withdrawal form is available on request). The refund is made within 14 days of your withdrawal, using the same payment method where possible; it may be withheld until the goods are returned or you provide proof of sending them. You cover the direct cost of returning the goods and are liable only for any diminished value from handling beyond what's needed to check their nature and features. Only the actual statutory exceptions apply (for example goods made to your specification or sealed hygiene items that were unsealed) — standard event merchandise is not exempt just because it was collected at an event.
Conformity complaints. Separately from withdrawal, EzMrch — as the seller — is liable under statutory rules if the goods don't conform to the contract — as a rule for a lack of conformity that becomes apparent within two years. You can ask for repair or replacement and, in the cases provided by law, a price reduction or to exit the contract. Complaints sent to hello@ezmrch.com are answered within 14 days.
Your statutory rights are not affected. Nothing here limits the non-waivable rights you have as a consumer under EU Directive 2011/83/EU, the Polish Consumer Rights Act, or other applicable law.
This Section applies when the Seller & Responsibility Card names the event organizer (or another named seller) as the seller. That seller is the seller and your only contracting party for the purchase — EzMrch is not a party to it.
A reservation, not a binding order. At these events the online flow is a non-binding reservation: you reserve items and receive a pickup code, but no purchase contract is formed online and you pay nothing online. The purchase contract is concluded at the booth, when you pay the seller and receive the goods. Until then neither you nor the seller is bound — if you don't collect during the event, the reservation simply lapses.
EzMrch's role.EzMrch provides the reservation and booth software to the seller. EzMrch is not the merchant, does not receive your payment, and is not the fiscal seller — the seller takes your payment and issues the receipt, as shown on the Seller & Responsibility Card.
Your rights.Withdrawal (where the law provides it), conformity complaints, refunds and receipts are the seller's responsibility, handled as described on its Seller & Responsibility Card. Nothing in these Terms limits the statutory consumer rights you have against the seller.
Complaints about the platform. Complaints about the EzMrch service itself — the reservation flow, pickup codes, emails or the website — go to hello@ezmrch.com and are answered within 14 days. Notices that content or a listing on EzMrch is illegal or infringes rights also go to hello@ezmrch.com (Section 12).
Working with EzMrch as an Artist/Licensor is a business relationship — for artists, bands, labels and promoters acting commercially, not consumers. It requires a registered account and completion of the verification we require (identity, rights ownership, and the tax documentation needed for paying you) before licence remuneration can be paid. Keep your information accurate and your credentials secure — you're responsible for activity under your account, and sensitive actions may require additional re-authentication.
You represent, warrant and agree that:
Your remuneration is the share of merchandise sales agreed in your licence agreement, calculated as set out there and shown in your account together with aggregated sales statements. Remuneration is gross: where the law requires EzMrch to withhold tax on payments to you (for example withholding tax on cross-border royalties), we deduct it from your remuneration and remit it — there is no gross-up. To benefit from a reduced treaty rate you must provide a valid tax-residence certificate and the related documentation before payment. Your own taxes remain your responsibility. VAT on retail sales is EzMrch's responsibility as the seller.
If you are an event organizer using EzMrch in software mode (Section 6), your commercial relationship with EzMrch is governed by a separate Platform Services Agreement — a B2B contract that is not part of these Terms. It covers the software service, fees, data-protection roles and your responsibilities toward Buyers as the seller. These Terms still govern your use of the Service itself.
EzMrch and its licensors own the platform, software, branding and technology; you get a limited, non-exclusive, revocable licence to use the Service for its intended purpose. Artists retain ownership of their licensed designs and content, and grant EzMrch the licence set out in their agreement to manufacture, market and sell merchandise bearing them and to host and display them in the Service. You may not copy, reverse engineer, scrape, or misuse our trademarks.
You may not use EzMrch to break the law; infringe others' rights; upload malware; gain unauthorized access, scrape, or circumvent security or rate limits; impersonate anyone; send spam; resell the Service without authorization; or build a competing service from access to ours.
If you believe content or a listing on EzMrch is illegal or infringes rights, report it to hello@ezmrch.com with a link and a short explanation — we review such notices and act on them.
Our data practices are described in the Privacy Policy. In short: for Buyers we process your email, order contents, and a random browser session id; for Artists/Licensors and organizers, account, verification and remuneration data. At events sold by EzMrch, Buyers' personal data is not shared with Artists — they receive aggregated sales statements. At events sold by the organizer, the seller sees the order data needed to fulfil your reservation, as its own data controller. We never receive or store full card numbers.
Buyers can stop using EzMrch anytime — there's no account to close (sessions are anonymous and can be cleared from your browser). Artists, Licensors and event organizers may end the relationship as set out in their agreement with us; outstanding orders, remuneration and tax records are settled per these Terms, that agreement and the law. EzMrch may suspend or terminate access for breach, suspected fraud, or legal requirement, with notice where reasonable.
These Terms are governed by the laws of Poland, without prejudice to the mandatory consumer-protection rules of your country of residence. You're always welcome to contact us first at hello@ezmrch.com — we usually resolve things quickly — but this never limits or delays your right to bring a claim. After a complaint is handled, Polish consumers are informed about available out-of-court dispute-resolution options (such as ADR before the Trade Inspection or help from a municipal consumer ombudsman). Consumers keep the protections on court jurisdiction that the law gives them.
We may update these Terms; the date above reflects the latest version. For material changes we'll give reasonable notice, and those changes apply only to orders and transactions entered into after they take effect.
